Insurance associations of Ukraine support bill on reforming sphere of urban development

The Insurance Business Association together with the League of Insurance Organizations of Ukraine and the Kharkiv Union of Insurers supported the draft law “On introducing changes to certain legislative acts of Ukraine on reforming the sphere of urban planning” (No 5655) with the recommendation to adopt it at the second reading and in whole by the Supreme Council.
The relevant opinion of professional associations of insurers promulgated in an open letter, the association noted in a post on Facebook on Monday.
“The current text of the bill provides for liability insurance of authorized persons for urban planning control. Considering the international insurance and reinsurance practice, we consider it advisable to further extend such practice to performers of certain types of architectural and construction works, who take part in the creation of construction objects, namely architects, design engineers, engineers for technical supervision and the like”, – notes the General Director of the Association “Insurance Business” Vyacheslav Chernyakhovsky, whose words are contained in the message.
As reported, the bill number 5655 provides for the activities of the examination of design documentation for the construction expert organization and implementation of urban planning control at the prior conclusion of the contract of professional liability insurance, without the presence of which the activities of the expert organization and authorized person for urban planning control is impossible.

UKRAINE TO IMPLEMENT STRATEGY OF REFORMING PUBLIC ADMINISTRATION

The Cabinet of Ministers of Ukraine approved the strategy for reforming the public administration of Ukraine for 2022-2025, as well as an action plan for the implementation of this strategy.
The relevant decision was made at the Wednesday government meeting.
“The new strategy is a continuation of the previous stage of implementation of public administration reform and is based on the results of the assessment of the government of public administration in Ukraine, carried out by experts from the Support for Improvement in Governance and Management (SIGMA),” Minister of the Cabinet of Ministers Oleh Nemchinov said in the Telegram channel.
According to him, some 82% of the surveyed citizens consider the reform of public administration important, some 65% of citizens are satisfied with the service in the centers for the provision of administrative services.
“At the same time, the introduction of the general administrative procedure, the reform of remuneration in the civil service and a number of other aspects requires implementation,” he said.
The main goal of the strategy is to build a capable service and digital state in Ukraine that protects the interests of citizens based on European standards and experience.
The expected results of the public administration reform until 2025 include ensuring the provision of high quality services and the formation of a convenient administrative procedure for citizens and businesses; formation of a professional and politically neutral public service system focused on protecting the interests of citizens; development of effective and accountable to citizens of public institutions that form government policy and successfully implement it for the sustainable development of the country.

MP DUNDA REGISTERS TWO BILLS ON REFORMING URBAN PLANNING SPHERE IN UKRAINE

MP Oleh Dunda (the Servant of the People faction) registered in the Verkhovna Rada bills on reforming the State Architectural and Construction Inspectorate and enhancing liability for violations in the urban planning sphere.
Relevant bills No. 5071 and 5072 were registered by the MP in the Verkhovna Rada on February 16, the website of the parliament said.
According to the explanatory note to bill No. 5071, which is available to Interfax-Ukraine, the bill provides for the introduction of phased state control over the construction process, which is carried out by local self-government bodies. State supervision is carried out by the central body of state power, which ensures the formation and implementation of state policy in the field of construction, one of the deputy ministers is also the chief inspector of the state urban planning supervision.
The bill also proposes to expand the range of entities providing services in the construction sector, subject to their certification. In addition, compulsory liability insurance is provided for certified persons in the field of urban planning (architects, design engineers, technical supervision, experts, etc.).
According to the provisions of the bill, a building permit will be granted if there is a positive conclusion of a comprehensive examination of design documentation, posted in the register with the qualified signatures of an expert organization.
Commissioning of facilities of CC1 class is carried out on the basis of an act of readiness of the facility, drawn up after its inspection in the presence of the customer, and signed by the technical supervision engineer and the author of the construction project. In the case of CC2 and CC3 class facilities, registration of a free state certificate of acceptance of the facility into operation is also carried out, which is formed after the signing of the act of readiness by the contractor, the head of the expert organization, experts and the insurer. These documents are also included into the register.
In turn, bill No. 5072 provides for an increase in fines for violation of legislation, building codes and regulations, including during planning and development of territories, violation of environmental safety rules, failure to comply with legal requirements of officials of state construction control and supervision, as well as personify liability for these violations.
In addition, it is proposed to introduce administrative liability for violations in the issuance of expert conclusions, author’s and technical supervision, performance of work without a qualification certificate or insurance contract, etc.
Criminal liability is provided for the issuance of a deliberately unlawful expert conclusion, violations by the executors of urban planning activities, non-implementation of state control and supervision, indicated in the explanatory note.
