UKSATSE WINS CASE AGAINST UKRAINE INTERNATIONAL AIRLINES

The Supreme Court of Ukraine supported the position of the Ukrainian State Air Traffic Services Enterprise (UkSATSE) to oblige Ukraine International Airlines (UIA) to conclude an agreement for the provision of air navigation services, which deprived the airline of the possibility of non-payment of debt for received services.
According to the press service of UkSATSE, on September 30, 2020, the Commercial Cassation Court within the Supreme Court of Ukraine refused to satisfy UIA’s cassation against the decision of the North (Pivnichny) Commercial Court of Appeal on the need to oblige the airline to conclude an agreement for the provision of air navigation services.
Earlier, the North Commercial Court of Appeal fully satisfied the appeal of UkSATSE against UIA on the settlement of disputes and the company’s obligation to conclude an appropriate agreement.
“Attempts of the debtor airline to appeal this decision to the Supreme Court today received a final decision, as a result of which it was declared the need to sign an agreement between Ukraine International Airlines and the Ukrainian State Air Traffic Services Enterprise for the provision of air navigation services and to determine a charging mechanism, which is standard for all Ukrainian airlines,” the company said.
As reported, the Economic Court of Kyiv region in August 2020 declared the absence of discriminatory terms of the UkSATSE service agreement in a dispute with UIA.
UIA filed a lawsuit against the discriminatory terms of the air navigation services agreement in the autumn of 2018.
